Compass asserts that NWMLS functions as a monopolistic entity, with its structure dominated by major traditional brokerages like Windermere. According to the complaint, nearly all residential transactions handled by Seattle brokers occur within the NWMLS framework, which lacks significant competition. This purported monopoly influences NWMLS to enact regulations that limit options for home sellers.

Impact on Homeowners

The complaint highlights that NWMLS’s practices restrict homeowners’ ability to engage in pre-marketing strategies, vital for potential sellers. Compass points out that outside of Washington, homeowners often have the option to list properties as “Coming Soon” or “Private Exclusive,” which provides them with advantages in the market. The suit argues that this difference significantly disadvantages Seattle homeowners.

Challenges to Rule Modifications

Compass claims that after multiple requests to alter NWMLS’s Rule 2, which governs exclusive listings, their suggestions were ignored. The complaint details that NWMLS only responded after a lengthy period, ultimately rejecting Compass’s proposals. Consequently, Compass sought to adapt its marketing approach, offering a non-exclusive listing agreement, which NWMLS subsequently countered by enforcing additional compliance regulations.

Consequences of NWMLS Actions

According to Compass, NWMLS’s actions not only harmed their business model but negatively impacted homeowners by limiting marketing alternatives. In response to Compass’s efforts to implement distinct marketing strategies, NWMLS intensified its regulatory framework, further consolidating its market position.

Seeks Remedies Through Legal Action

Compass is not only seeking damages but also a permanent injunction against NWMLS’s current practices, which it claims violate the Sherman Antitrust Act. The firm argues that NWMLS’s conduct undermines competition and stifles innovation, ultimately depriving homeowners of the choices and benefits available through Compass’s services.

The Context of the Legal Dispute

This conflict intensified earlier in the year, following a public exchange between Compass CEO Robert Reffkin and NWMLS CEO Justin Haag. The exchange began with an Instagram post where Reffkin criticized NWMLS’s policies. Subsequently, a website named Washington Homeowner Rights emerged, aiming to gather potential plaintiffs for a class action lawsuit against NWMLS, alleging that homeowners have suffered due to its policies.

As of now, NWMLS has not provided a public comment in response to the ongoing legal dispute.
